Many of us will experience stressful situations in our lives. However, experiencing stress at work can negatively affect your mental and physical wellbeing.
Your physical and mental health are not separate entities; they are one and the same and should be treated as such. If one falls out of balance, the other often follows and tips the proverbial scales, thus causing stress to the individual.
An individual’s volume of work most commonly causes stress at work. The nature of the work itself, such as a job where an individual has to deal with complaints from clients or customers constantly and does not have proper training or counselling available to them, often contributes to workplace stress.
Stress can also be caused by victimisation or bullying at work. Perhaps, by a manager or superior abusing their authority or by work colleagues who have singled out one particular individual.
However stress happens, it’s an incredibly unpleasant experience for the individual. In our latest blog, we’ll discuss how MLA can help your client make a claim and start to improve their wellbeing in the workplace.
How does my client start a claim for stress in the workplace?
To start a claim with MLA and our Expert Panel, your client will need to demonstrate the following to have grounds to begin legal proceedings:
- They have suffered from a recognised psychiatric illness such as clinical depression;
- That the psychiatric illness was caused by stress at work;
- That they were negligently exposed to stress at work; and
- That their psychiatric illness is a direct result of their employer’s negligence.
How MLA can help:
A Clinical Psychiatrist from our Expert Panel will examine your client and prepare a medical report containing a review of their medical records, witness statements, OH and training documents, HMRC and cover medical history, symptoms, diagnosis, treatment received and prognosis.
Comments will also be made on how the client’s life and their ability to continue working have been negatively impacted and whether they incurred a loss of earnings and future loss of earnings.
